Hi everyone

I have scheduled my interview at the Sydney Consulate on 12 January
using the online booking service.

If my husband is coming with me and wants to apply for the E3 dependent
visa, does he come to the interview with me?

I can't find the answer anywhere! Any help appreciated!!

Cheers :-)

I'm currently on an E3 VISA working in Manhattan and have found a better
job opportunity within Manhattan too. I will need to transfer my E3 to
another employer and have already given my two weeks notice to my
current employer.

What would I need to do to transfer this VISA? Can I do it from within
the US or would I need to leave the country again and goto another
interview?

Is there any permanent residency path stemming from the E3?

I am in much the same position as aaremms. My employer really wants me
to come to USA and work on a 2-3 year project NOW!!!. We cannot get a L1
visa, as the USA COMPANY doesnt own the Australian Company even
though we trade under the same name. I cant get an E2 Visa, as the
original E1 Visa holder is not Australian. H1B Visas are all full and do
not allow for my spouse to work so really the only option here is an E3
visa. Good ol Johnny...

As the E3 visa doesnt allow for an easy path to a Green card I have
accepted that this will be a transfer rather than immigration. So I will
be keeping my house and a few other possessions in Australia. I also
have some immediate family who will remain in Australia. I think I will
have no problems proving I do not intend to stay in America. However. I
would be interested in finding out who has jumped from E3 to GC and how
they managed it. Because...

E3 makes you somewhat at the mercy of the employer. "At will" contracts
and 10 days to bail out of the country makes you more of a Gypsy than a
" skilled worker in a demand position" O.K. if your 25 I guess. My
advise is if you are in demand and have the opportunity to negotiate is
to negotiate a fixed term employment or get the employer to agree to pay
a "going home " fee. Its not like they are employing chuck from Texas...
employee - employer relationships always start out friendly but you cant
predict the future...

Here is my 1st problem..

I am not an Australian citizen even though I have been in Australia as a
PR for almost 20 years. I have completed the form for an Aussie
certificate booked the interview and paid the fee but I have no idea how
long I need to wait before the ceremony and Im going to miss the Jan
26 events. (My interview is after this date.) I am checking daily for
cancellations. I can image rocking up to some country town to attend
the ceremony (my range is most of the east coast of Australia as I have
very good friends who fly light aircraft.)

Once I get the Citizenship the passport will be 2 days with a premium-
processing fee and its then of the consulate with the shortest waiting
time for the E3 Visa. I will be holding my Aussie passport open so the
pages dry on the plane..

I am going to get my employer to complete the form ETA 9035CP In advance
which I understand to be the LCA so many have talked about. Interesting
this form does not mention the name of the prospective employee; just
the number so I guess this is the process for approving the employer as
a Sponsor. So I believe I can get the LCA completed even though I am not
an Australian (yet)

My spouse (also an Australian PR) will accompany me to USA, choose the
apartments curtains and then submit the I 765 (I think) and then return
to Australia to arrange the packing of the furniture. I will be
working...

So far pretty straight forward. Expensive but necessary as the project
is worth the effort.

Heres the 2nd problem. .....

In my efforts to secure a senior position (2IC in a large company I
forgot to pass go and collect a degree.) I finished High School and have
worked continuously in this industry and my field for more then 20
years. The last 17 with the current employer. So I'm hoping that this
will be enough to convince the powers that be that I have sufficient
credentials to get an E3. I have read that 12 years work experience
equals 1 degree. Do you have to get this certified somewhere?

I am interested in hearing from other successful or (non successful) E3
candidates with experiences similar to mine. Its easy to do a Google
search and find the legal terms ... but facing a human, albeit through
a plate of glass is a slightly different issue.

Default E3 interview and 221(g)

hey all,

I am an aus citizen and went for the E3 visa interview couple of days
ago. Well, instead of visa I got this form with a check list of
documents required from my american employer(called 221(g)) . The dude
who interviewed me explained that I am qualified for the visa but he is
not sure if the American company will have projects for me to do there
and hence he needs these documents. Now even tough the employer in
America is keen and preparing the documents for me but I me kinda pissed
off as I was carrying all the documents that the consulate web site
advised me to carry for E3 visa.
Instead the dude kept on asking me what other information do you have
about the company and kept on telling him that no one indicated anywhere
that I will be asked for this information.
So, Ill appreciate if someone can shed some light on this 221(g)
business. Is this a visa denial and does this means I cannot travel to
US on visa waiver anymore in case i do or dont get my E3 visa. Also is
it more difficult for them to approve the visa now even when employer
does send all the documents.

cheers,
Kit

hi kit_g

i am also in the same boat as u. I was told to submit additional
information about my employer like photos, tax returns,etc.. its already
more than 4 months i am yet to hear from melbourne consulate. 221g
simply means ur visa decision has been temporarily suspended. this
usually happens is there is any document missing or the VO needs more
information.. well this is the situation. try to contact consulate but
only if its more than 6 weeks they will reply you. Well i am still
waiting for the decision..

good luck

I went to Ottawa last week and had no problems getting the E3 visa. I
recommend getting degree or employment docs evaluated thru an agency eg,
American Evaluation and Translation Service Inc
(www.aetsinternationaol.com (http://www.aetsinternationaol.com)) and the
employer write the letter of offer mentioning job responsibilities and
that these are relevant to previous experience (or degree).

I used the 3 for 1 ruling where I had a total of 12 years of references
describing previous roles. The AETS wanted all these original docs.
The Consulate in Ottawa only asked what will my duties will be and I
referred to the letter of offer and mentioned my past experience relates
to the duties, ie, a speciality.

I hope this helps.

Hi,

Iam an australian citizen applying for E3 visa.I have an offer letter
from an employer in US for an IT job.As part of the documentation
requested i was asked by my employer to provide the following
documentation :

(i) Copy of the Business Partnership Deed, for a business either fully
or partially owned by the instant Beneficiary, reflecting that he
is maintaining financial ties to Australia, and intends to return
there on completion of his current E-3 assignment;

OR

(ii) Original Job Offer letter from an IT company in Australia,
confirming that the beneficiary will be hired in the position of a
Programmer Analyst, on his return to Australia.

I dont have any business to provide business partnership deed nor can i
get a job offer letter from an employer here for a future date.I dont
think any employer can offer me job for a future date, as my return
from US would be uncertain and why would any employer offer me job when
my return time frame is uncertain? Any E3 visa succesful applicants,
please let me know if any of you provided this document and is this a
deciding factor?

Also, is it necessary that i need to show relevant experience letters,
as the job offer i got now is different from my current job profile.

Please help.
