I adjusted status in the US. Going to a consulate is a crazy idea IMO -
waste of money for flights, long lines at the consulate and a nerve-
racking interview.

OK thant's nice, I wasn't aware that E visas can adjust status (you know
all that dual intent stuff).
Anyway, can you tell us a bit more about the procedure? did you need to
do medical tests? apart from the I-140 and 485 what form did you need to
adjust status? Did you acctually receive the GC, and how long did it
take after the petition was approved? Was everything done solely by
corespondence?

Thanks for the reply. I am in the midst of doing the same thing.
Currently, the lawyers are doing the labor certification for me , Is
Labor certification the same as LCA? I remembered we have to apply for
LCA for E3.

I was also not aware you can adjust status on E3. My lawyer told me the
last stage has to be done at the consulate. If you could give us more
info on this it will be very helpful to a lot of readers here. Thanks

I've been for a few interviews and I dont think it really matters.
You're "interviewed" behind a huge glass window and its not as personal
as you may imagine. I would just dress respectively.

guys, for those of us who do make it to the US - whats the best way to
transfer money back to Oz? Is anyone paying off a mortgage from
overseas? and if anyone has experience with applying for an aussie
mortgage with a US paycheck?

Had my E-3 visa interview at Calgary, Canada consulate. I was in the US
for 5 weeks when I got my offer and decided to come here to shortcircuit
things. Found the interview slot last Friday.

Arrived at 7:45am, interview was at 8:30am. Went through security and
got my number. Was called and application taken from me. I was told to
wait for my name to get called. 5 mins later a nice lady called me up
and told me the machine had rejected my pic. I quickly ran downstairs
and got another one taken.

I went back in, handed my new pic in and was told to wait. 5 mins later
got called up for interview. The guy was quite rude and hostile from the
getgo so I geared myself for the worst outcome. I couldn't really
believe what I was seeing. He was literally shouting at me.

I'm an attorney and the job if a legal consulting role for a US telco
firm doing business in Aus. The interviewer said I don't meet the
specialty occupation req cause I didn't have a "current" practising
certificate. I have an older one that I submitted together with an
affidavit from the Law Society that I'm fit and proper and eligible to
get another certificate upon application.

Anyway, he put my application on hold and told me to go back with the
certificate. I think he got it wrong though cause the US consulate
website says you can qualify for Specialty Occ if you're eligible to get
a license within a reasonable period of time.

Quick update, went back to consulate this morning with more documents.
They told me everything was fine but they need to do security check and
then they'll issue. They never asked me a single question about job,
company, or my professional background.

For those interested in Status Change within the US, I was on a H1-B and
my wife on H4. My lawyer filed for a change of status (I-129) for me and
a I539 for my wife on the 12th of OCT and today I got a case update from
USCIS that both our cases have been approved. My lawyer said it would
take between 90 - 150 days.

Next step is to file for my wife's EAD. I was initially thinking I would
do premium processing for this but considering how soon they approved
our status change I am not sure if I should or not.

They mail the GC to you here in the US if you choose the 485 aka
adjustment of status route. It arrived a week after the approval
email. There is a different green card path called consular
processing, but it's a bad idea according to my attorney - it can be
slow, it requires you to leave the US, and is much more prone to
mistakes. With the 485 everything is done on paper and there is no
interview (beyond a medical).

Amazingly my PERM took about four months and the concurrent I140/I485
process took less than four months. Prior to that I filed a regular
labor certification in 2002 and it got stuck in the backlogs for four
years. I'm still in shock that I finally have it. :-)
