Default Do need Optional trainning b4 changing the H1B?

Dear all,

I am currently holding a F-1 visa and will set up a new c-corporation and office here in the US. Just wondering if I should get the Optional/Practical Trainning first in order to change the status to H-1B? Or, I can apply H-1B directly? Also, is it possible for me to apply L-1 even though none of any tax or salary record can be obtain in my home country company?

In addition, in my brother's case, he is holding J-1 and B1/B2 visa but the DS-2019 has already expired. What is the best way for him to making application, H-1 or L-1 under the circumstance of going to set up companyu in the US.
