Default Disappointment CSC I-751.

Below is a post by Denis sometime in July 2006. Just like him, I am
disappointed too.

I don't know what is going on but my I-751 has been pending in CSC for
16 months. I am still married with my spouse. I just patiently
waited; I was surprised to received a letter to appear for interview.
At the interview, the officer took my expired GC 2 yrs that expired may
2005. He asked for 2 copies of passport photos. No decision after
the interview; officer did not say how many wks or months to wait for a
decision. I don't have anything now in my possession; no more 2 yrs
GC;, passport is not stamp. I was very disappointed. I should have
just filed an N-400 (just like Denis, posting below) somewhere in may,
june, july , August 2006 (that is 3 yrs after permanent residence was
granted).

I would like to ask some suggestions from the group whether to proceed
to apply for the N-400.

Do you guys know what is the processing time for N-400 in California?
how does N-400 works? I thought of not applying N400 because I am just
sick and tired of collating paperworks and then visiting the USCIS
building again and again and again. I give up now.

I am disappointed and depress thinking about this.

to be processed at CSC for almost 13 months.

Well, the time came to file my N-400 and I duly posted it on June 28th
and, according to USPS it reached CSC on June 30th


At the end of last week I received an I-797 for my N-400 with a
priority date of June 30th (Exactly one year later than my I-751)


You could have knocked me down with a feather when I got another I-797
on Monday with my Biometrics appointment for this Saturday (7/22)!

Hi Urla,

My advice would be to go ahead and file the N-400 as soon as possible.
My receipt date for my N-400 was June 30th and I have my
interview/test on January 11th. Although you send the N-400 to CSC it
will be dealt with by your local office (Phoenix for me) so you should
look up the N-400 processing times for your local office to give you a
rough idea of timescale.

I believe the N-400 forces the adjudication of the I-751 but I'm sure
someone will correct me if I'm wrong so you have absolutely nothing to
lose (and everything to gain) by filing your N-400. You should also
get an infopass appointment and at least get a stamp in your passport
so that you can travel etc.

You are so close to the end Urla, don't give up now.

You are allowed to file for naturalization whether or not your I-751 has
been adjudicated... in fact, the N-400 application will force
adjudication of the I-751. So, file now. Naturalization is the *only*
way to get USCIS off your back permanently.

Actually, I'm surprised that you've never made an InfoPass appointment
to ask someone face-to-face about what happened to your I-751... but
that's a whole different issue.

Hi:

I find your post somewhat confusing. You state your I-751 is pending at
CSC, yet you were interviewed. Which one is it?

You can file an N-400 -- not a bad idea.

You can also make an InfoPass appointment. If you are in the Los
Angeles District and your interview was on Soto street, you might try a
walk-in inquiry [note the "try"].

URLA,
was an interview for your I-751 or just a biometrics? Did your wife go
there with you, was she present at your interview? What questions did
they ask, if you dont mind sharing your experience with us?

I was interviewed yet no decision after the interview; hence, it is
still considered pending - right?

I would say it is still a pending case (I751) because I did not
received an approval notice; patiently waited for 16 months; and then
this month my spouse and I appeared for the interview as scheduled.
After the interview the officer did not give a decision; although the
officer said they will communicate by mail pertaining to their
decision. Since the officer took my expired 2 yr green card, I asked
if I could get a stamp. The officer refused to give because the law
changes regarding stamp. Stamp are granted only for emergency reason
such as emergency travel.

Btw, I had no RFEs, and during the interview the officer did not look
at the papers that we brought along with us.

BTW, on the 12th month, I had an infopass apointment. I was sitted for
3 hours waiting for my number to be called. When it was my turn, what
I got was: No decision yet regarding your I-751. After that, I never
made any attempt to inquire about my case. I became disappointed
already by that time.

Thank you Denis. I haven't read the N-400 application form yet. Do I
have to go through with mountainous paperwork requirement again to file
for N-400? I hope not?

I will probably get a lawyer who will file my N-400 by next week. I
know it is expensive, but I'll just make a sacrifice to keep my sanity!

If he took your photos and your green card you should have been
approved. These are the actions an adjudicating officer does when one
is approved, not disapproved. Make an infopass appointment and ASK.

It took 18 months for our I-751 to be decided on. 12 months is not
unrealistic a wait. You are still a PR.

I hope you guys saw my responses... for some reason my reply did not go
after the last one in the thread. Sorry.

Btw, I want to add something. During the I751 interview, I had a
fingerprinting done at their office. (index finger, 2 times). I
forgot to ask what was that all about. Is that what you guys call
biometric. Is that part of the process?
