You can have a CIMT and still be eligible for the VWP in certain
circumstances. It must be declared, however. I'm confused about you
saying that no one went through customs/inspection due to Hurricane
Charley yet you spent the night on the airport floor. I would have
thought that flights would've been diverted long before landfall and
that an international flight would not allowed to land if
customs/inspection staff were not on hand. (In rare emergencies, yes,
but hurricanes are very predictable, you usually have plenty of advance
warning.) If you didn't go through customs/immigration, how did USCIS
get your I-94?
There are a lot of questions here, but the outcome is not good. Once
USCIS/DHS/DOS decide not to issue someone a visa, they will stick with
that decision barring some spectacular emergency that compels someone to
visit the US. They won't do it for a holiday. I wonder if travel
insurance will cover the costs if someone cannot enter their destination
country due to immigration issues?
