Default Dear experts, experienced and helpful members

i started to read the forum since one month but it is my first post
i am a indian national currently in canada under study permit one more
year to go.

last month i went to india and got married, my wife applied for
visitor visa but got refused due to lack of sufficient ties and fund
(as the letter stated) i had to return to canada alone to complete my
studies.

it was sad but life goes on. now the most appropriate thing would be
to apply for PR as i think we have enogh points to apply (is there
still some chance that she applies for Visitor visa again during the
process of PR??)

back to PR
a few questions to all the helpful members out here, i would really
apreciate your help and suggestion and will follow accordingly, thank
you in advance

1. since i will be applying at buffalo from canada, can i notarize my
wife's documents in canada?
2. can her bank balance in india be counted as a proof of fund along
with mine in canada?
3. in case i am called for interview, can i get a visa to USA, how
difficult is it to get the US visitor visa??
4. if both of us are called for interview, there is no way that we
both can attend the interview at US. in this case can we transfer out
file to New delhi? how frequent are applicants called for interview?
5. if that happens than it might be another long story, so it is same
as applying at new delhi initially rather than at buffalo, any
suggestons??

i need to know these things before i spend my 1100 bucks for
application fee, lot of paperworks, hassels (as paperworks are not
easy in india), tension. Having said that i see a bright future to be
a PR of canada

plz plz answer at least a single question if not all

one more thing about IELTS
i am planning to take IELTS because my old one is not valid now
can i send in my application and say that i will be taking the test
within few months and will send the scores later as soon as i get
OR should i put my other evidences first (and see if they work) and
wait for their response than only take test and send the scores once
they ask me to do so??

is there any chance that my application will be refused just because i
didnot submit the IELTS score (even if i explain them my other
evidences like old IELTS, job, education etc)

First, she can apply for another visitor visa at any time. No restrictions
there.

Second, getting a US visa is very difficult specially if you have never had
a US visa before and you are not in Canada as a permanent resident.

Third, for her to get a Canadian Visa is going to be very difficult because
she is going to be disclosing the fact that she is married to a Canadian and
the way the consulate is going to view it is as trying to bypass the normal
immigration system. Chances of denial are thus very high

Finally, I don't think you can apply for buffalo anymore. Don't quote me on
this, however I do believe that now you must apply from the country of your
citizenship or residence. Since you are not a US resident of citizen you
cannot apply from there.

If your circumstances have not changed then reapplying will only
result in another refusal.

1. Yes, you can notarize your wife's documents from India. However,
only few documents need to be notarized (degree certificate), others
need to be submitted in original or photocopies are sufficient.
2. If you have a joint account then surely yes else also it should not
be a problem since she is your wife but it is better to have money in
your name.
3. If you are decently established in Canada then your chances are
fair. By decently established I mean you on a work permit which is not
going to expire soon or on student permit (not expiring soon) with
funding and sufficient money in your bank account.
4. Transfer is solely at CIC discretion. If you are able to transfer
file to New Delhi expect to land as PR in another 6-8 years.
5. It is better to apply to Buffalo as processing times are lower. You
can apply to Buffalo if you have been admitted to Canada for a period
of atleast 1 year and are residing in Canada.

enigma boy, as i told that i am indian national lawfully admited in
canada as a student for two years (still one more year to go), why do
you think that i cant apply from canada to buffalo processing centre,
this is confusing me, i am sorry not for any offence but just trying
to clear myself.

one thing is bothering me alot,
i fixed my IELTS date for the last week of Nov (the earliest available
one), but documents like police certificates (for my wife) will
expire at the end of october (its not easy to make another police
certificate and will take some more time ), my canadian visa will also
expire at the end of october next year (i know i will be extending my
visa but they will think that i have less than one year to stay)

so i am thinking to apply in this october to get rid of all these
stuffs

now the thing now is, even if i submit my proficiency in writing they
will surely not accept that and will ask me to write the IELTS exam.
I am still afraid, if they refuse my application just because i didnot
submit my IELTS results with my application (do they usually refuse or
give one chance to justify your english sufficiency claim through
IELTS??) - if they give one more chance to justify your claim that i
will have my scores ready by then and i can submit. but if they refuse
my initial application it will be very sad.

or is it better and faster if i say in my initial application that my
IELTS test is on the following date and i will be submitting the
results as soon as i get??

which would be safer and faster?? i will be relaxed if i can get this
thing solved, thank you once again for your suggestions, please help

If you claim full 16 points for English, you are not well above the
passing marks and do not submit IELTS result, then most likely you
will be asked to appear for IELTS. You will get a letter stating that
"we are not satisfied with the proof that you have submitted and hence
request you to submit English language test results failing which we
will award points based on documents submitted". But be sure to
include written proof of language proficiency/IELTS score with the
initial application else it will be returned.
