Default Citizenship

Hi

I have just been reading about the plan to change the residency period
from 2 to 5 years

We validated our visas via a 2 week trip in October this year and plan
our permanent move for Summer 2007

If the scheduled date of change of 1 July 2007 materialises do we need
to move to Australia before that date or is the validation trip
sufficient to begin our period of residency?

I dont believe the finer details have been disclosed yet but people seem
to be suggesting that you will have to be living in Oz as a permanent
resident (i.e. on shore) before the rule change in January to still
qualify for citizenship under the old rules.

Yes thats when the rules are supposed to be changing. There is quite
a bit of talk about it in the thread which is a Sticky at the top of
this forum.

Dear N11,

I don't imagine you're aware of the special emotional significance that
date has for Australians - have a look in Wikipedia if you're bored.

No-one knows the exact details yet, however I understand that July 2007
is now the most likely starting date for the amendments, and afaik it's
not a five year proposal (eek!) but you can see from the latest
legislative proposals that people who already have their PR may be able
to go through under the Citizenship Act as it currently stands: http://www.citizenship.gov.au/law-and-policy/legislation/changes200406-

Just bear in mind that a lot of this is still under negotiation and
nothing is settled.

Thanks for the reply. Here's hoping that we move out to Australia in
time!

I believe you have mentioned the significance of my name when replying
to another of my endless questions!....

....November 11th 1880, the day Ned Kelly was hanged in Melbourne jail?

Thats good news George (depending on how you look at it) as obviously it
gives a lot more people a better chance to apply for citizenship after 2
years residency rather than the proposed 4 years.

Yes, but there will only be a "window" of 3 years from Commencement Day
to clock up the 2 years and apply. Otherwise there will be a 4 year
wait anyway.

G'day,

I have already applied for my 136 and expecting to receive my PR
around Apr - May next year. I have already clocked up more than 3
years on a 457.

The interesting thing for me is that if this regulations goes in on the
1st of July 2007, I will need 2 years for citizenship since the old
regulations would be applicable as opposed to 1yr ( assuming 3yrs
exemption ) if the regulations go on the 27th of Jan 2007.

I am kinda hoping that the changes are effected early next year,
selfish me...

.. and the date of the Whitlam government dismissal in 1975. When the
perpetrating Governor-General, Sir John Kerr, died, they found that he
had been suffering from a disease which had atrophied large parts of his
brain. He was accused of being drunk at the Melbourne Cup a couple of
years later, but it was just accelerating brain damage, apparently.

Kelly on the other hand was an extraordinarily articulate and insightful
individual as his letters show - in another era he would have been a
revolutionary.
