I have a issue about change of status. I was studying my graduate
degree on F1 visa. when I was about to complete my education in December
2002, a company offered me a job and changed my status to H1. Mean time
I had applied for one year OPT (Employment Authorization , it was taking
4 months to get the EAD) few weeks before the company applied for my H1.
So I got the OPT EAD card after the H1 approval.
Few months after
joining the job, I got laid off due to job reduction because of company
mergers. While in job, I was busy and could not complete my education.
Since I had not completed my graduate degree, I changed status from H1
to F1 for the same course and graduated in December 2003. Before the
expiration of my previous OPT time (expiry 1/31/04), I applied (reciept
date 1/22/04) for the change of status as dependent H4 to my wife's H1
visa (My wife has H1 visa). The INS has sent a query asking proof that I
am maintaining my F1 status, also to include a letter from my Designated
School Official. My school has issued a supporting letter to me that -I
could not register for the classes due to my OPT, and so I had applied
for change of status to H4 before OPT expired.
I have to reply to
INS before March 5th. Can I reply with proof of my OPT card and the
letter from school ?. Is my previous OPT card (obtained for the same
graduate course)was valid the second F1 status? Please help.
