Folks,

Here is a hypothetical situation.



Say after 6 years of H1B work in USA, I have to move out of USA, and I
happen to have posses Canadian PR status. In such a situation, as a
Canadian resident, will I be permitted to come and continue work without
a break in USA.



Or even Canadian PR, in any way, will not fetch me and my two grown up
children any escape from complete uprooting our lives from USA. I heard
Canadian PR card holders are allowed to work in USA...not sure whether 6
yrs rule is applicable on them too or not..

-------Canadian PR needs work visa like H1 or O-1, to work in US,
Canadian Citizen can work on TN visa

dont you have your LC pending? if your LC is pending more than 365 days
you can get 7th year H1 extension

By company attorney mistake, LC was filed late by 60 days. Now he is
filing to capture 69 days when I was on H1B visa but was out of
USA......do not know whether he will able to do so or not. If i have to
go out, I was wondering whether it would be possible for me to continue
this work (now say on TN visa) in continuation of H1B or not...

Dear you cant use or get TN visa to work in US because you are not
Canadian citizen you are just PR of Canada. Search for any other
approved LC with your employer or with other employer and if you find
any approved LC that matches with your education, skills before the
date LC was filed then try to file I-140, I-485 with LC substitution.



I have read in many posts that BCIS normally don’t allow capturing 60
days. If you have H1 then your lawyer can try to get it extended for
the time you were out of US and you need the evidence to prove it and
it all depends how your lawyer drafts the letter for H1 extension. DOL
will not listen to your lawyer as he filed 60 days late and DOL does
not capture the dates out of USA

Unfortunately if you have to go back better go back to India( if you
belong to India) India has much better IT jobs at this time. Canada has
no IT jobs you will spend all your savings. Only labor jobs are
available in Canada. Those who landed 2 years back in Canada could not
find any jobs in Canada many have gone back to India.
