Default Asking again about I-212 question

Sorry to post this again, but got no response and wanted to have another go
in case there was a problem with it getting to some servers

Hi,
My husband needs to file an I-212 application but we are a bit confused on
one of the questions.

He was deported almost 6 years ago at his own expense after defaulting back
into an old visa status (visa waivor which had expired) after a petition was
withdrawn.

What we are confused about is Question 7:

Circumstances under which deported....

Excluded and deported (less than one year ago)
Arrested and deported (less than five years ago)
etc


All options are for less than one or five years. So, does he leave this
question blank or check one and cross out the word "less" or what ??

If the deportation was more than 5 years you do not file this document.

Uh, why? This was the advice of a lawyer, but I'm not sure if it was under 5
years at the time (I think it was just over 5 years).

Please give more information if poss.
