Default applied for green card - need reentry on H1B

Hello everyone,

I hope someone will be able to help me. I have an H1B
status and my company has recently applied for my green card. I am
having to leave US and apply for reentry H1B visa. I have previosuly
gotten H1B reentry visa without any problems but I noticed on the
application that one of the questions being asked is whether I have ever
applied for an immigrant visa.

Since H1B is a dual intent visa I would
think that there should not be any problems with applying for reentry
while the green card application is in process?

Does anyone have any
thoughts on this?

You are right, this question will not be a problem for you.

By the way, read the question carefully. If it truly says "have you ever
applied for an immigrant visa" the answer would be "NO". A labor
certification has been filed on your behalf. Possibly also a petition, or
an adjustment of status application. But unless you go for consular
processing, you never applied for an immigrant visa.
