Default Application in Process since Aug. 2002 - What's up?

Hi. We put our application for skilled-independant visas all the way
back in August of 2002. In August of 2003, we got the assessment back
with a score of 110. They shorted us the five bonus points needed due to
a change in the MODL after we applied. Based on the points assessed, we
figured that the application was basically dead (pooled) and left it at
that. Today, a different agent with DIMIA sent out the request for
Medicals and Police Records. In the new correspondence, the reference
number is now stated as: <Case#>-<Agent#>-Region 2. Frankly, we were
surprised to hear anything at this point. We did email the agent back to
ask if anything had changed with our application to get the process
going again. In her response, she stated that they needed the medicals &
police documents to continue processing the application and confirmed
that we were not "pooled" as pooled applications do not require this step.

My question to you guys would be what would cause them to start back up
with our application given the 110 points assessment? Does the "Region
2" noted correlate to some sort of state sponsored application. The
agent said she would provide us with further information at a later
date. I guess what I'm ultimately trying to determine is whether they
are actually going to continue processing the application after all this
time given that we didn't have the 115 points? We are applying from the
United States, so I don't know if some rule changes are getting it going
again. Do we have a shot at getting this thing approved or are we going
through the motions and wasting our time? Any insight would be
appreciated. Thanks.

Hi Newman,

Most likely you calculated your points wrong. Send me a cv or details by
email if you like, but I don't see why you would want to challenge it...

George,

Thanks for your reply. I can assure you, however, that I did not
calculate the points wrong. I have a letter from DIMIA dated 8-4-03
stating that our application had been scored at 110. Due to my
profession (Accountant) being dropped from the MODL, we were short the
final 5 points necessary. Given that I have confirmation from them that
I didn't hit the passmark, it seems curious as to why the application
would suddenly continue processing at this time. Could this be a test
case for the so called "Bush" visa that I've been reading about
recently? If so, I'm not sure that we would be interested in a
restricted visa. Due to the additional work experience that I've gained
while waiting, I figure that I would be assessed 120 points if I
reapplied today. The problem is that DIMIA won't tell me what they are
processing my current application for (i.e. skilled independant, bush
visa, state sponsored, etc.). Is there any way to determine that? I'll
forward you the details by email to see if you can shed any light on
this. Thanks again.
