Default any advice at all will do!!!!!

Hi all



I have a 14 year old son from a previous marriage, who has always lived
with me, his step dad and step brother. His 'real' father has refused to
give permission for him to migrate with us to australia (if we get the
visa granted!!!). I know I will have to go to court, but.....has anyone
else had to do this, and what are my chances of the court granting me
permission? My son loves WA and is desperate to live there, as we all
are.....he's a surfer dude!

If it comes down to a court case you will need an order from the court
allowing you to remove the child from the jurisdiction of the court.
There are some variations between England and Wales Law and Scottish Law
(and Northern Irish Law) - but the effect is the same.



The Hague convention is what this relies on and Australia is a
signatorory to this.



If you go to court it generally takes between 3 and 6 months to get a
hearing and if it is contested the decision can go either way.

I'm in the USA and also will have a teen minor. Her father has never
sought visits or custody though he has been paying child support. I
have no idea what his feelings would be..is there a way to prove his
lack of interest so he wouldn't need to be contacted? It may not be a
problem for him though I suspect he might consider stopping the
support payments.
