Another Medical Exam needed for AOS?
Hello. My wife got her medical exam done in Ukraine in March 2004 just
before applying for her K-1 visa. She gave the sealed envelope to the K-1
interviewer in Ukraine. We also attached a copy of her DS-3025 (Vaccination
Documentation Worksheet) to her I-485 application.
Her AOS interview letter now says: "If you have not already submitted it,
bring a completed medical examination (Form I-693) AND vaccination
supplement in a sealed envelope."
A list of doctors in the area has also been included with the AOS interview
letter.
Does this mean she needs to get another medical exam now?

BTW, our AOS interview letter said the same thing, but we ended up not
needing either a new medical NOR a vaccination supplement. You'll read

No, she does not need a new medical exam. The exam is good for a year.
Even if you had gone over a year, there is a BCIS memo also,
stating that K1ers don't have to redo med exam if they filed for AOS in
timely manner. Basically, it is their fault that they are so behind on
giving an AOS interview after people have filed. I had to wait almost
two years from filing. I took a copy of the memo, just in case I needed
to slug it out (metaphorically speaking!) with the examiner. But she
didn't ask for med exam. All you need to take is the vaccination sheet.
Even though you have already submitted it, BCIS regularly misplaces
paperwork. So take all originals to the interview again, along with copies.
The other thing to point out is that quite often, these immigration
forms are used on more than one type of visa. And not all visas require
a medical upfront.

We are k-3 and we filed our aos in March of 2004, my husband came to the
United States last March, and he had his interview in Montreal. My
question is does he have to have another medical since we are k3 and if
so will they let us know when we get our interview letter, and another
question .....my husband could not find his vaccination record so they
gave him all the hepitatis shots and drawed blood to find out that he
has had all his immuzations shots.......
please answer me

The memo covers all AOSers who filed properly (eg in a timely manner),
and with no A class or B class medical conditions. So if your hubby is
healthy you should be covered. ( I have no idea what A or B class is.)

I don't think anybody gets a specific note saying whether or not they
will need a new medical. You know what the BCIS is like, they just send
out the generic form. Print out a copy of this memo and take it with
you when you finally get to interview so you can produce it if he/she
asks for a medical. Bear in mind the memo is only valid until Jan 2005,
but Im sure they will issue a new memo if you havent had your interview
by then. You WILL still need the vaccination suppliment.
So, in a nutshell, you don't have to worry about a new medical, just
take memo to interview. Get all vaccinations done, ( I had to have all
mine done again for the same reason, if it's any consolation :) Take new
vaccination records to one of the civil surgeons listed by BCIS and ask
for the vaccination suppliment to be filled only. Don't let them talk
you into the whole medical. Then you're good to go.

I would hesitate to give a clear-cut answer, because it REALLY depends
on the USCIS office, regardless of what the actual regulation says on
their website.
Some people have done the vaccination supplement, only to be told they
also needed a new medical (even though the original medical was done
within a year of filing). Others, like my husband, did not need a new
medical exam NOR a vaccination supplement. Unfortunately, like most
things with USCIS it seems, these things are not set in stone.
That's why I always suggest that people contact their local USCIS office
directly and ASK. If you ask by mail, then you'll get an official
response in writing, which is always a nice thing to have. In our case,
it saved us time and money not having to get the vaccination supplement,
which we were surprised they didn't want but that was fine with us!

Brenda,
I came to US on k-3 as well, March 2003, about three months later sent
all doc for AOS in Charlotte, NC . I did not have to do another medical
only one vaccination which wwas requested by BCIS. I really don't know
if the same rules apply in every other office. Perhaps you can somehow
contact local office and get more informationor maybe someone knows more
about that matter. I had my AOS interview July 2004,and already received
Pernament residency card.If you have more question please e-mail or post

I am presuming that the Memo overrides all. And I am thinking that the
only reason that it varies from office to office is because some are
more educated than others in the way of the BCIS rules. It is not
unknown for somebody to be told something wrong by an officer, only to
be corrected when a supervisor is involved, or a memo/bulletin being
produced. That's why I told Brenda to take a copy with her.
