Agents or anyone- Changing or updating a 136 MODL?
Hi,
I have just got a job offer, the employer has a labour agreement and
knows that I have a visa being processed (a July application using my
wifes skills). The other new employees will be going into Oz under this
Employer sponsored visa.
I understand that the Employer sponsored route is faster, in the event
that there is a delay in processing my application under 136 MODL I
could be waiting for my visa while the other applicants/new employees
are in-country and available for work. We have front-loaded and we
recieved our acknowledgement in August.
My question is should I write to the DIMA and inform them of my
employment and quote the labour agreement reference in order to try to
speed things up, change my application or wait and see?
I am guessing that I am not the first person who has been in this
situation, your advice and experience would be appreciated.

Hi Bruce,
No, wouldn't make any difference, they won't jump the queue for that
sort of reason, particularly as you probably haven't been skills
assessed. Anyway, there's nothing stopping your employer bringing you
all over on a 457; you can validate the 136 with your first trip home.
Now if your wife has a MODL occupation and had the job offer it might be
different...

Hi Haley,
It's a queue, but within that, since there are so many regions and case
officers, the managers have some leeway, so if you have an application
with a good case for acceleration (generally involving provable facts,
eg employer needing employee urgently) then you can put it to them, and
sometimes they'll listen. I have to add that I don't think self-
inflicted injuries such as expiring medicals or having sold a house or
having quit your job are strong enough reasons for acceleration.
From an agent's perspective, this may not work every time and 99% of
cases don't have clear enough evidence to request acceleration, so don't
get your hopes up too much, you might be stymied by the RCMP clearances
or internal checks.

Thanks George,
We shouldn't be held up too much as we have already sent in police
checks (done in Setpember) and will be doing medicals in about a week.
So I figure everything should be there mid to late November. The only
hold ups should be on there end as I have been meticulous with
documentation etc.
I certainly won't count on anything speeding up, only a job offer would
have the potential for that. I just figured that if we were due to get
a case officer in December that a job offer might speed it up a week or
two. Not much of a difference in the grand scheme of things.

Just wanted to say congratulations on the job offer
So do you think you'll go over on a 457 then and wait for your 136 to
be granted?

I don't know what a 457 is, I really don't know yet.
By th time we sell our house me may have a visa, it depends if we have a
nightmare with the house or the visa. You keep hearing tales of visa's
being overlooked etc

457 is a temporary business visa, not the same as a labour agreement
which can be either temporary or permanent.

Thank you, hopefully we will get a CO jan/feb and our visa a few weeks
after that (July 11 applicants who have frontloaded). If we sell our
house soon that only leaves a few weeks at our rellies before we can go.
We may even fly out and go to NZ to have the visa's granted. I'm still
thinking about it, there are still plenty of unknowns yet.
Oh and thanks for the congrats, I may be getting another job offer in a
week or two. So much for my staying by the pool while the wife goes out
to keep me in the manner . . . .
