Default Age-out Problem Over 21 :F4 Family Based Immigration Visa for USA

Sirs, Madams,

This is amit, I wanted to know about cspa in simple words with formula,
cause we putted our file in 1996 which is now going to current or
priority but due to this waiting period i turned over age that above 21.
so, my question is what i have to do for going with my parents cause i
cant live without them.

!) is there any procedure to go with them?
2) can i take advantage of cspa?
3) should i write or request to consulate regarding this?
4) if u suggest me to along with my parens on the time of interview what
i have to carry i mean which documents...
5) is there any suggestion would u like to give me.


as my parents' visa fee already filed but not my cause age out.

So your Parents were sponsored by a sibling?

Ask them not to emmigrate. They could apply for you as PR's, but a 10
year plus wait.

dear,

yas my parents sabling file the immigration file, and i don't want
repetition.

Not knowing the details of your parents application, I can only quote
from our own experience. We were asked to give details of any children,
who were under the age of 18 when the application was approved, who were
emigrating with us. As it happened both our children decided they
wanted to stay in the UK. Things might have changed in the past few
years so you might be best advised to check with an attorney.

Tell me the following details and then I'll let you know if you qualify
or not. My brother just got the visa (same F4 category) with CSPA even
after the embassy refused to give him the visa bc he was 22 years 1
month old.

1. Whats your priority date?
2. Whats your approval date?
3. How old were you when your priority date became current? (or it is
still not current)?

Formula:

(Your age when priority date become current)-(Approval date-
Priority date)

<= 21 years 45 days

Fahad,

As I read your posts, I see you are quite familiar with this CSPA age-
out issues, so I'm wondering if you can provide official evidence on how
to calculate CSPA age with Patriot Act 45 days gracious period. My son
has similar situation, our visa becomes current in August (F-4 petition)
and my family might get an IV interview in September. Details as below:

Priority Date: Oct. 16, 1996
Approval Date: Dec. 4, 1996
Age when visa became current: 21 years 62 days

NVC said that my son's name has been deleted from the derivative
beneficiary's list, however, he can remain eligible under this F-4
petition if the Consular calculate his age with Patriot Act 45 days, in
that case, he can benefit from CSPA. I'm going to make an appeal for
the consulate to reconsider his eligibility. How can I convince the
consular office to determine he is eligible?
